DW LLC (“DocuWhiz”, “us”, “we”, “company”, or similar terms) respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes the types of information we may collect from you or that you may provide when you visit www.DocuWhiz.com and portal.DocuWhiz.com (the “Site”) and our practices for collecting, using and disclosing that information.

  • a. By using this web site, you are agreeing to this Privacy Policy. If you do not agree to any term of this Privacy Policy, your choice is not to use this Site. This policy may change from time to time. Your continued use of this web site after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

We reserve the right to modify this Privacy Policy, as well as our Terms & Conditions, at any time. Such changes, including retroactive changes, are effective once posted on this or a similar page of our web site. This entire site, specific pages or features of this web site may be discontinued or changed without notice.

4. Information Collected

We collect information from you when you fill out a form on the site or to subscribe to a newsletter. When registering on our web site, you may be asked to enter your name, e-mail address or other personally identifying information. You may, however, visit our Site anonymously. We also may collect information from you when you visit our web site, including information this is personally identifying or information about your internet connection, the equipment you use to access our web site and usage details.

We and our third-party service providers also use a variety of technologies, such as cookies (small text files that the Site save on your computer or mobile device), to automatically collect certain technical information from your computer or mobile device over time and across different websites, including when you use the Site, such as your browser type, operating system, device type, the page served, your IP address, your geolocation, and the websites you visited prior to visiting the Site. When you download and use one of our Apps, we and our service providers may track and collect App usage data, such as the date and time the App on your device accesses our servers and what information and files have been downloaded to the App based on your device number.

We and our third-party service providers may use the information collected through these technical methods for a number of purposes, including delivering content, tracking and enhancing our Users’ experience on the Site. For example, when you return to the Site after logging in, cookies help the Site recognize who you are without having to log back in. We do not allow third-party advertising networks to collect information about Users who are logged in to their Accounts.

If you do not want the Site to collect information through the use of cookies, you can set your web browser to reject cookies from the Site. Each browser is different, so you should check your browser’s Help menu to learn how to change your cookie preferences. However, please note that if you reject or block cookies from the Site, the Site may not function as intended. For example, you will not be able to remain logged in to your Account, and therefore you would have to log in during each page transition.

    Location Information
    We may collect and store information about your location to provide you with experiences or email updates that are tailored for your region. The location information we have access to may include (1) your ZIP or postal code, if you provide one to us; and (2) the approximate geographic region your computer or mobile device is located in, as determined from your IP address. However, we do not collect your street name and the name of your city/town. You may be able to change the settings on your computer or mobile device to prevent it from providing us with such IP information.

    Push Notifications and SMS
    Additionally, if you downloaded the App on your mobile device to access the Site, as part of your use of the Site we may ask if you would like to receive push notifications, which may include alerts and notifications, badges, banners, and sounds on your mobile device. You may choose to stop receiving push notifications at any time by changing the settings on your mobile device. We may also ask if you would like to receive SMS text messages. Please note that your carrier may charge you for the text messages you receive. To permanently stop receiving SMS text messages from us (if you are located in the U.S. or Canada) text STOP, CANCEL, or UNSUBSCRIBE in reply to any SMS text message sent by us.

5. Use of Your Information

We will never sell or rent the PII of any User of the Site to a third party, except as described in this policy in the context of a sale of the Company.

  • a. The information we collect from you may be used in one of the following ways: (1) to personalize your experience, (2) to improve our web site, (3) to improve customer service, (4) to provide you with information that you request from us. In any other way we may describe when you provide the information and for any other purpose with your consent.
  • b. Information collected from Users will not be disclosed except as follows:
    • i. To third parties who perform certain services for us, such as process credit cards or conduct or evaluate research (such as on the educational impact of the Site), provided that the service providers agree to keep the information confidential and to use it only for purposes that are permitted by this Privacy Policy.
    • ii. As we believe to be necessary or appropriate as set forth above in Other Uses and Disclosures and in other instances substantially similar to those listed in this Section.
    • iii. Where legally required and in certain other cases, we may make such disclosures without first providing notice to Users.
    • iv. Subject to confidentiality agreements, the terms of this Privacy Policy, and applicable law, information may be disclosed to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, transfer, or license all or a portion of our assets in bankruptcy or otherwise. This means that if some or all of our assets are acquired or otherwise transferred or licensed, including in bankruptcy, that such acquirer shall be subject to the same commitments stated under this Privacy Policy.

6. We Protect Your Information

We implement a variety of security measures to maintain the safety of your personal information when you enter, submit, or access your personal information. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our web site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

7. Disclosure of Information

We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information except in the following circumstances: (1) to trusted third parties who assist us in operating our Site, conducting our business, or servicing you, so long as those parties agree to keep this information confidential; (2) to our subsidiaries and affiliates; (3) to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of DocuWhiz’ assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by DocuWhiz about our Site users is among the assets transferred; and to fulfill the purpose for which you provide it. We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

  • a. We may also disclose your personal information: (1) to comply with any court order, law or legal process, including to respond to any government or regulatory request and (2) to enforce or apply our Terms of use and other agreements, including for billing and collection purposes; and (3) If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of DocuWhiz, our customers or others.

8. Online Privacy Policy Only

This online privacy policy applies only to information collected through the web site, in e-mail, text or other electronic messages between you and this Site and not information collected offline or by a third party.

10. When you become a DocuWhiz Client

If you select to change your site user status to subscriber status, your agreement with this Privacy Policy remain. The subscriber will provide “USER” status to its employees, independent contractors or third parties, hence the term “user” is referred to one who uses DocuWhiz, henceforth, on behalf of its subscriber.

  • a. Your information is defined as any information you post on the Site or otherwise provide to DocuWhiz. You are solely responsible for Your Information, and we act as a passive conduit for your online distribution and publication of Your Information. Your Information and your activities on the Site shall not: (1) be false, inaccurate or misleading; (2) be in violation of any federal, state or other law, rule or regulation relating to rights of privacy or otherwise; (3) be defamatory; (4) contain any viruses, Trojan horses, worms, time bombs, cancel bots, Easter eggs or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; or (5) create liability for DocuWhiz or cause DocuWhiz to lose (in whole or in part) the services of its ISPs or other suppliers.
  • b. You shall not copy, reproduce, modify, create derivative works from, distribute or publicly display any Care Recipient’s PHI or other Site content except to the extent agreed to by us in writing and as permitted by HIPAA and other applicable federal and state laws, rules and regulations. We do not sell or rent the personal information of users to third parties for their marketing purposes without your explicit consent and we only use your information as described in the Privacy Policy. We store and process your information on computers located on the most secure services and in the United States that are protected by physical as well as technological security devices.
